Junta de propietarios

Todos los propietarios reunidos. Es el órgano soberano: aprueba los presupuestos y las cuentas, y elige los cargos.

All owners together. The sovereign body: it approves the budget and the accounts, and elects the officers.

Presidente · Vicepresidente

El presidente se nombra entre los propietarios, por elección o, en su defecto, por turno rotatorio o sorteo. El cargo dura un año salvo que los estatutos digan otra cosa. El vicepresidente es opcional y sustituye al presidente en su ausencia.

The president is appointed from among the owners, by election or failing that by rotation or lot. The post lasts one year unless the statutes say otherwise. A vice-president is optional and stands in when the president is absent.

Secretario · Administrador

Pueden ser la misma persona o dos distintas. El cargo lo puede ocupar un propietario o un profesional cualificado, como un administrador de fincas. El administrador custodia la documentación de la comunidad y la tiene a disposición de los propietarios.

These may be one person or two. Either post can be held by an owner or by a qualified professional such as an administrador de fincas. The administrador keeps the community's documentation and makes it available to owners.

Una junta ordinaria al año, como mínimo

At least one ordinary meeting a year

La junta debe reunirse al menos una vez al año para aprobar los presupuestos y las cuentas. La convocatoria de la junta ordinaria anual se hace con seis días de antelación como mínimo, e incluye el orden del día.

The junta must meet at least once a year to approve the budget and the accounts. Notice of the annual ordinary meeting is given at least six days in advance, and includes the agenda.

Convocar una junta extraordinaria

Calling an extraordinary meeting

Puede convocarse cuando lo pida la cuarta parte de los propietarios, o un número de propietarios que represente al menos el 25% de las cuotas de participación.

One can be called when a quarter of the owners request it, or owners representing at least 25% of the participation quotas.

Qué debe constar en el acta

What the minutes must contain

Fecha y lugar, quién convocó, si es ordinaria o extraordinaria, la relación de asistentes y sus cargos, el orden del día, y los acuerdos adoptados con los votos y las cuotas. La firman el presidente y el secretario en el plazo de diez días.

Date and place, who convened it, whether ordinary or extraordinary, the list of those attending and their positions, the agenda, and the agreements reached with the votes and quotas. Signed by the president and secretary within ten days.

Impugnar un acuerdo

Challenging an agreement

Pueden impugnarse judicialmente los acuerdos contrarios a la ley o a los estatutos, los que perjudiquen gravemente a la comunidad, y los que causen un perjuicio grave a un propietario. El plazo es de tres meses, o de un año cuando el acuerdo sea contrario a la ley o a los estatutos. Para impugnar hay que estar al corriente de pago, salvo que la impugnación se refiera a las propias cuotas.

Agreements can be challenged in court where they are contrary to the law or the statutes, seriously harm the community, or gravely prejudice an owner. The limit is three months, or one year where the agreement is contrary to law or statutes. To challenge, you must be up to date with community payments, unless the challenge concerns the quotas themselves.

Qué se recoge y para qué

What is collected, and what for

Únicamente los datos de la reserva de cita: nombre, correo electrónico, teléfono, número de vivienda y el motivo de la cita. Se usan para concertar y registrar esa cita, y para nada más. Esta página no mantiene ninguna lista de correo.

Only what the appointment booking asks for: name, email, phone, property number and the reason for the appointment. It is used to arrange and record that appointment, and for nothing else. This site keeps no mailing list.
